Many issues related to cryptocurrencies, which are described as the financial revolution, are still in the air. One of them is the laws regarding the use of cryptocurrencies.
When we talk about laws, we usually think of sanctions to prevent criminal behavior, but when we look at the other side of the coin, the laws protect our rights. It also prevents possible injustices.. Unfortunately, the fact that there is no clear law or regulation regarding cryptocurrencies, which can be described as quite new technologies and investment tools, can unfortunately pave the way for some injustices.
For example, for some professional groups to invest in cryptocurrencies, no clear lawmeans that our rights regarding our investment preferences are not protected and paves the way for possible injustices to be experienced in this regard.
Arif Kaygusuz, known as ParabolArfi on Twitter, described the injustice he suffered in this regard in a flood.
Arif Kaygusuz is not only a cryptocurrency phenomenon, but also a math teacher.
Kaygusuz, who recently shared the injustice he experienced due to the institution he was working as a mathematics teacher with his followers in a flood, was unfairly accused of being a crypto money phenomenon. have been laid off had told.
We reached out to Mr. Arif and conveyed our questions to get his thoughts on the injustice he experienced as a crypto money phenomenon and as a teacher.
In the flood you wrote on Twitter, you stated that you work as a mathematics teacher in a private institution and that the institution you work for terminated your employment contract, citing the argument that “playing crypto” to your job. Did the institution in question explain how “playing crypto” has to do with your business and why your investment choice as an individual investor worries them?
First of all, I have to say that it was a very surprising process. For the first time in my life, I encountered a process that started with the fact that the crypto phenomenon that I did in my private life was not welcomed among the students and that the parents’ feedback “Is your teacher interested in these things?” They said it would give the impression that I was defrauding people. The next process is known, the termination of the unilateral employment contract.
At a time when teachers needed to be versatile, my contract was terminated at the end of a conversation that started with “sir, you were playing crypto”. Their concern is based on the fact that crypto is viewed as a scam.
Is there any legal basis for terminating your contract on the grounds that you are investing in the cryptocurrency markets? On what laws, if any, did they terminate your contract?
Of course, it has no legal basis. The contract was a contract with the right to terminate unilaterally. I thought of seeking my rights through legal means, but I did not want to make my daughter and wife experience the weariness of this process.
Was there a restriction stated by the institution that teachers working within the institution could not use crypto money markets as a financial investment tool or was there a warning about this issue before your contract was terminated?
No warning was given on this matter, there was only one conversation, and at the end of the conversation, I was informed that my employment contract was terminated unilaterally. There were no restrictions on their financial investments, and there shouldn’t be any. Investing is basically a process that people make individually and progress with their own decisions. The real problem starts with crypto. As you know, after what happened on the THODEX stock market, looking at those in the crypto sector in our country as scammers is like getting angry with fleas and burning the quilt, which is exactly what happened to me.

Is there a common perception that teaching and similar professional groups are not welcome to invest in crypto money markets?
We come across it very often. Those who hear that you are trading in the crypto money market, even in friendships, greet you with the perception of “the scammer has arrived, welcome”. In teaching, the process is starting to be presented a little differently. You are faced with thoughts such as “What if he makes my child a ‘crypto guy’, or he wants my money too”. Although these thoughts are not directly introduced to you, you feel and understand with the experience of my profession. This is, of course, a sad situation.
Before you start working at a new school, do you think about asking the relevant institution whether this issue will pose a problem by talking about your investment preference and your status as a crypto phenomenon, in order not to experience the same situation?
I have always preferred to be transparent, and I always will. I will openly express this in my meetings with a new institution. If there is to be a problem, it is necessary to see it from the beginning and meet it. At the moment, I have meetings with a few schools abroad, and when I told them about this, they were initially surprised. Then they conveyed that there are projects where we can combine my financial experience with mathematics. In other words, the perspective abroad is much different and positive compared to our country.
If every school agrees on this subject, would you risk quitting the crypto phenomenon or would you consider turning to another profession?
I don’t want to quit the phenomenon. I am happy in this ecosystem. I will continue even if I go abroad. A person should be where he is happy and I am happy here. I think I will continue to teach and learn even if I turn to another profession. I do not think that teaching is a profession that is done only within the four walls of the classroom. In fact, I continue to teach in the field of science.
As a crypto phenomenon, do you think it is your responsibility to change this negative perception towards crypto money markets?
Actually, this process starts with us phenomena, you are right. I know that many phenomena are in what kind of ponzi and they are in the processes we call rugpull. The problem actually starts with the fact that they see the priority in their pockets, while the phenomena should be directed towards science, mathematics and finance. As long as one for all and all for one reasoned, both finance and crypto wouldn’t really be like this right now. In fact, the time has come for us to take responsibility too.
Do you plan to take an action to raise awareness so that your colleagues working in the private or public sector are not in a similar situation with you?
It’s really hard to take action on this. I took a lesson and I told this lesson to them, even if it was a flood. My colleagues have really supported me in this regard, I have received hundreds of messages; Offers came from many schools, in different provinces of the country. As I said, I work in a profession with high awareness and I think that my colleagues are as good at taking lessons as they are at giving lectures.
So are there really any legal restrictions on investing in cryptocurrencies?
Due to the absence of a clearly stated prohibition on the use of crypto assets in Turkish legal legislation, the use of cryptocurrencies legal can be said to be.
In terms of civil servants, the use of cryptocurrencies should be evaluated in terms of criminal law, tax law and disciplinary law.
In terms of criminal law In order for an act to be considered a crime, it must be recognized as a crime with a clear legal regulation. There is no definition in the law regarding the criminalization of investing in cryptocurrencies. Investing in cryptocurrencies not included in the crime.
In terms of tax law On the other hand, there is no regulation regarding the taxation of cryptocurrencies yet. When evaluated within the scope of the trade ban for civil servants, it is because crypto assets are not much different from dollars, gold, stocks and similar investment instruments and basically generate income from the change in the values of these assets. not covered by the trade ban. is considered.
In terms of disciplinary lawwithin the scope of the obligation to declare the property, the officer who invests in crypto money receives It is sufficient to declare income is seen.
