Copyright cases over generative AI are now getting harder to pursue. This time, the authors are suing the NVIDIA NeMo AI system, a language model that allows businesses to create and train their own chatbots. They claim that the company trained the AI on a dataset it used books without permission.
NVIDIA is being sued for AI copyright infringement
Authors Abdi Nazemian, Brian Keene, and Stewart O’Nan are suing, asking NVIDIA to pay damages and destroy all copies of the Books3 dataset used to power NeMo large language models, Ars Technica reported. This dataset, they claim, replicates a library called Bibliotek, which consists of 196,640 pirated books.
The statement of claim is as follows: “NVIDIA has acknowledged that it trained NeMo Megatron models on a copy of The Pile dataset. So NVIDIA must admit that it also trained its NeMo Megatron models on a copy of Books3. Because Books3 is part of The Pile. Books written by Plaintiffs are part of Books3, and therefore NVIDIA directly violated Plaintiffs’ copyrights.”
In response to this claim NVIDIA, “We respect the rights of all content creators and believe we have created NeMo in full compliance with copyright laws.” said.

Last year, OpenAI and Microsoft were hit by a copyright lawsuit for works they profited from and refused to pay authors. A similar lawsuit was filed earlier this year. A lawsuit was subsequently filed by news organizations such as The Intercept and Raw Story. Now NVIDIA is facing a lawsuit.
