So what does the new social media law bring?

According to the regulation introduced in Article 4 of the law regulating the internet media, “making news in a way that creates anxiety, fear and panic among the public, and making false statements about the internal and external security of the country, public order and general health” are included in the scope of punishment. According to this, those who make and spread news in this way can be punished with imprisonment from one to three years.

Articles 309, 311, 312, 313 and 314 of the TPC, which also envisage “aggravated life imprisonment”, will come into effect in crimes against the constitutional order and “espionage”.

In the proposal, in order to reach the perpetrators who create and spread internet content related to constitutional crimes, the public prosecutor will be able to request the necessary information, upon the request of the court, during the prosecution phase. If this information is not given, the bandwidth can be reduced by 90 percent. In addition, an advertising ban can be applied to the platform.

In addition, the social media law paves the way for issuing press cards to the managers of associations and foundations who are found to be operating in the public interest.

If the press card of a journalist with a press card is cancelled, a new press card will not be issued for 1 year from the date of cancellation, or for 5 years if there is a more severe condition, even if the cancellation decision is lifted.
