The Ministry of Commerce changed the Distance Contracts Regulation with the decision numbered 31932. The return of technological products purchased over the internet such as smart watches, phones, tablets and computers will not be possible after the new regulation enters into force.

New Distance Sales Contract, postponed to a future date

According to the revised regulation, consumers will no longer be able to return arbitrary products. The new regulation, which prevents the return of the product even if the package of the received product is not opened, will work in favor of the consumer under certain conditions.

If the purchased product is defective, it can be returned. However, it is stated that in this case, the consumer will bear the shipping fee during the return process. In addition, the time for consumers to ship the product in the return and exchange process has been determined as 14 days.

With the regulation published in the Official Gazette today, technological products can no longer be returned at the request of the consumer.

If people who shop with a credit card use the installment option, the entire amount will be returned at once by the bank after the return process. The changes will take effect on January 1, 2024.

Moreover, not only because it is second hand, but also if the received product is brand new and its packaging is not even opened, it cannot be returned. Because it will be considered as one of the cases where the consumer uses his right of withdrawal arbitrarily. But there is an exception here.

The text published in the Official Gazette is as follows;

ARTICLE 1- Article 18 of the Regulation Amending the Regulation on Distance Contracts published in the Official Gazette dated 23/8/2022 and numbered 31932 has been amended as follows.

“ARTICLE 18- This Regulation;

a) Subparagraph (g) of the first paragraph of article 5, which was amended by article 3, article 9, subparagraph (b) of the seventh paragraph of article 12/A, added with article 10, article 11 and article 13 were dated 1/1/2024. ,

b) Other provisions on 1/10/2022,

enter into force.”

ARTICLE 2- This Regulation enters into force on the date of its publication.

ARTICLE 3- The provisions of this Regulation are executed by the Minister of Commerce.
