The provider of a kindergarten in Cloppenburg was of this opinion and insisted on the clause in the employment contract, according to which any voluntary allowance had to be repaid if a teacher left the company within twelve months.

However, the Oldenburg labor court saw this as an unreasonable disadvantage for the employee, since the so-called commitment period of twelve months was too long. In addition, the bonus of 550 euros granted for 2020 was paid for services already rendered and the special burdens during the pandemic. So it shouldn’t be reclaimed.
