SEC-Ripple Case: Experts Believe SEC Is at a Disadvantage

Chamberlain’s comments followed a recent decision by Judge Analisa Torres, which equally allowed and rejected both parties’ motions known as the “Daubert” motions.

As we have reported as Koinfinans.com, the opinions of experts are very important in the ongoing lawsuit. Neither the SEC nor the XRP community seem to have taken advantage of this decision as the judge allowed and rejected some of the motions from both parties.

One of the most significant consequences of the decision was the removal of leading expert witness Patrick Doody from the case. The SEC contracted with this firm to investigate investors’ expectations for XRP.

Another result of the Daubert objections is that SEC lawyers, Judge Torres, advocate for the XRP community. John E. DeatonIt was an effort to disqualify him from participating in the case. This was because Deaton disclosed the name of the SEC’s expert witness. The judge, however, did not ban Deaton. Instead, Judge agreed with Deaton that Doody should not testify for XRP holders in court.

Deaton also shared his opinion on Twitter in support of Chamberlin. “I believe the expert’s blocking is fatal to the SEC’s summary judgment request,” he said.

XRP community attorney Jeremy Hogan voiced similar views, noting that the SEC needs to show that Ripple has a “responsible” profit expectation from its efforts, and Doody plays a key role in this.

Hogan wrote: “And the Judge also removed the SEC’s ONE expert witness on the matter. Now, how can the SEC prove ‘reasonable’ trust? Who will testify?”

While the judge ruled in favor of the SEC on the 3rd expert witness, which Ripple considers “relevant and reasonably biased,” Hogan considers: “Expert #3’s view on Ripple’s incentives and actions to influence the XRP price is on profit expectation. relevant in relation to the question of reasonable expectation.” But according to him, this is a “weak thing”, which means that it will not be very useful in solving the case.
