Russia May Seize Cryptocurrencies and Digital Assets in Bankruptcy Cases

Authorities in Russia took action to seize cryptocurrencies of bankrupt organizations.

Local sources reported that the Russian Ministry of Justice and the Federal Bailiff Service (FSSP) are about to give bailiffs more authority to seize cryptocurrencies in bankruptcy cases.

The Ministry of Justice’s new practice also includes giving bailiffs the authority to impose liens on various digital assets, including digital rubles (CBDC), cryptocurrencies, tokenized assets, securities and qualified intellectual property titles (NFT).

Enforcement officers will be supplied with modern equipment so that they can “fulfill their legal obligations more effectively”.

Another proposal of the initiative is to give enforcement officers the authority to open investigations or conduct preliminary investigations regarding crimes related to bankruptcy proceedings or detected during these proceedings, which are currently under the jurisdiction of the Ministry of Internal Affairs.

The Ministry of Justice also plans to legalize the sale of seized digital assets via electronic methods. In this case, bailiffs can put the seized digital assets up for sale through cryptocurrency exchanges.
