New Regulation on Used Car Sales: Ministry Announced!

The Ministry of Commerce announced that the Regulation on the Trade of Second-Hand Motor Vehicles will be amended in order to take measures against stocking and exorbitant price increases in the automotive sector. With the amendment, until January 1, 2024, marketing and selling of second-hand motor vehicles at a price higher than the current sales price recommended by the manufacturer or distributor, through advertisements is prohibited.

In addition, with this amendment, it was stated that the real or legal persons mediating the placing of advertisements are obliged to warn those who make false advertisements before the advertisement is published and to convey the information about the advertisers to the Ministry of Commerce. The obligation to warn will include the information on the current sales price of the vehicle recommended by the manufacturer or distributor to the advertiser, and the information that the advertised price to be entered constitutes a violation of the regulation.

The Ministry of Commerce will be authorized to determine the class, brand, type, type, model year of second-hand motor vehicles and, in case of adding accessories and equipment, the maximum amount and/or rate that can be added to the current sales price recommended by the manufacturer or distributor.

It has been announced that the regulation change will enter into force on 15 July 2023. This regulation will be applied to cover individual or commercial advertisements of all real and legal persons.

In the statement made by the Ministry of Commerce, it was emphasized that these measures were taken to prevent stocking and unfair practices in the automotive sector, to ensure a competitive market structure and to eliminate consumer grievances. Advertisements that do not comply with these regulations may be subject to administrative fines.

In addition, it was shared that the previously announced “6 months-6 thousand kilometers marketing and sales restriction” has been extended until January 1, 2024 and that the sales of 3 or more second-hand motor vehicles without authorization will be prevented through Notary Publics. The Ministry of Commerce announced that by closely examining the records related to the sales of second-hand motor vehicles, it has identified the individual and corporate sellers who have made illegal sales and that their defense will be requested from these sellers. Taking into account the defenses, it was stated that administrative fines could be imposed on the persons in question in the coming days.

The Ministry of Commerce emphasized that it will resolutely continue its inspections and sanctions in order to prevent the unjust treatment of consumers against supply-demand imbalance, attempts to gain unfair profits and unfair commercial practices in the sector.
