Ex-Wirecard boss Braun goes before the Federal Constitutional Court

Berlin According to a newspaper report, former Wirecard boss Markus Braun is going to the Federal Constitutional Court in a dispute with insolvency administrator Michael Jaffe. Braun’s lawyer confirmed this, reports the “Süddeutsche Zeitung”. The complaint against the Higher Regional Court (OLG) in Munich was filed on May 11, the paper quotes lawyer Bernd-Wilhelm Schmitz as saying. The judgment of the Higher Regional Court in January was incorrect.

The court had ordered an asset arrest against Braun’s private investment company and thus ruled in favor of Jaffe. It is about a payment of 35 million euros that Braun received in spring 2020 just a few weeks before the collapse of Wirecard from former board member Jan Marsalek.

Jaffe and the Munich public prosecutor’s office suspect that the millions were diverted from the group via a chain of transactions in order to shift them to Braun, which was in financial difficulties. Braun had stated that he did not know where the money came from.

Wirecard collapsed three years ago after 1.9 billion euros from business with customers in Asia, which are said to be in escrow accounts, turned out to be non-existent. CEO Markus Braun and two other top managers are on trial for gang fraud and misleading the capital markets.
