Cum-Ex business: lawsuit against Sparda-Bank Berlin

Cologne Sparda-Bank Berlin has sued two former business partners, ABN Amro from the Netherlands and Bankhaus Lampe. The cooperative institute demands a total of a higher double-digit million amount.

Sparda-Bank lost both lawsuits in the first instance. Now the higher regional courts in Düsseldorf and Frankfurt have to deal with the legal dispute.

The complaints became known on the sidelines of the searches at Sparda-Bank this week by the Cologne public prosecutor. The investigators suspect current and former employees of the bank to have committed tax evasion – right up to the board of directors.

The potential perpetrators are said to have participated in so-called cum-ex deals. When trading shares using the Cum-Ex method, the actors can be paid taxes that were not paid at all.

Sparda-Bank Berlin is one of several smaller banks that have not been conspicuous in these joint-stock group transactions so far. However, there were first indications of their involvement in a cum-ex criminal case at the Bonn Regional Court.
