300 thousand TL penalty for deceptive advertisements in second-hand sales!

The regulation that will ruin the dreams of everyone who is opportunistic in sales of new and second-hand cars, especially galleries and dealers, was published in the Official Gazette yesterday. No second-hand vehicle manufacturers and distributors will be able to be sold above the current sales price and advertisements will not be placed on various sites. But opportunists found the solution by subtracting 2 zeros from the advertised prices. The Ministry of Commerce, on the other hand, brought a very deterrent penalty.

300 thousand TL penalty for deceptive advertisements in second-hand sales!

In the post made by Fatih Uysan, Press Counselor of the Ministry of Commerce, the text we included in the continuation of our news was included. Here, it was said that a deterrent penalty that we have not seen in a long time will be applied to those who break the rules and act as opportunists.

For example, in the image above, we see that after the regulation, which states that second-hand vehicle prices cannot exceed the zero price, people put their vehicles up for sale by writing a few zeros missing. For example, the new price of the car is 700 thousand TL. However, since it is out of stock, second-hand opportunists or those who stock up sell it for 800-900 thousand TL.

However, after the new regulation, it was said that if the zero price of that vehicle is 700 thousand TL, it cannot be advertised even for 700 thousand 1 TL. For this reason, those who want to sell at the level of 800 to 900 thousand TL open their ads as if they are selling at 80-90 thousand TL. On the phone, it is said that one zero is missing. So it’s just an opportunistic tactic based on fraud and breaking the rules.

The Ministry of Commerce, on the other hand, said in its statement today that an administrative fine of up to 300 thousand TL will be imposed on these advertisements within the scope of second-hand motor land vehicle trade. So, if you want to sell the used car from scratch and do this with deceptive advertisements, a high penalty awaits you if you are detected.

The statement made by the Ministry of Commerce is as follows:

“As is known to the public, on 06.07.2023, the Regulation on the Trade of Second-Hand Motor Vehicles was amended, and the marketing of second-hand motor land vehicles by advertisement at a price higher than the current sales price recommended by the manufacturer or distributor was restricted until January 1, 2024. Any advertisement contrary to this regulation will be accepted as second-hand motor land vehicle trade by our Ministry, and an administrative fine of up to 300 thousand TL per advertisement may be imposed on those who place these advertisements.

However, with the publication of the regulation, it has been determined that the vehicle advertisement prices are entered or updated by discarding zero on the advertisement sites. In addition, the news on social media regarding announcements of this nature reach our Ministry.

In order to circumvent the said regulation, advertisements of this nature that are both deceptive and misleading to the consumer and do not carry reality will also be evaluated within the scope of the said advertisement restriction, and an administrative fine may be imposed by our Ministry on those who place these advertisements. In this context, our Ministry held meetings with the advertisement platforms and warned its members within the scope of this restriction at the advertisement entries, and warned that all necessary measures should be taken in this regard.

Our Ministry will continue to take all kinds of additional measures in order to eliminate practices that cause consumer grievances within the scope of combating hoarding actions and exorbitant price practices in the automotive sector.

It is announced to the public with respect.”
