Supreme Court of Montenegro, Terra (LUNA) overturned a decision by lower courts to extradite developer Terraform Labs co-founder Do Kwon to the United States or South Korea.

Kwon’s extradition has been a matter of debate for months. In its press release on Friday, the Supreme Court stated that the decision on extradition should be made by the Minister of Justice, not the court. This decision came after the court overturned the decision to extradite Kwon to South Korea last month and the former manager appealed.

Kwon, who is facing criminal charges in both the USA and South Korea, was arrested in Montenegro in March 2023 for using a fake passport while trying to leave the country.

His lawyers reportedly favored his home country of South Korea, where the maximum sentence for financial criminals generally ranges from 30 to 40 years, less than in the United States.

Still, the Montenegrin government plans to approve extradition to the United States, according to a person familiar with the matter who spoke to Bloomberg in late February.

The Supreme Court of Montenegro stated the following in its statement of the decision:

“In a situation where there are competing requests from two States for the extradition of the same person, rather than a conflict of requests for the extradition of the same person, as found by the lower courts, the court’s obligation, in accordance with its powers, is to determine whether the legal requirements for extradition have been met in relation to each petition.” is to determine separately as; After this, the competent minister, not the court, decides on the permission and priority of extradition.”
