Social Media Law passed the commission!

The Social Media Law was submitted to the Parliament towards the end of last May. After the work, it was announced that he passed the commission. Accordingly, it must be finalized within 45 days at the latest. So now it’s my last step.

However, those who spread fake news and share misleading information on the Internet face prison sentences. This will include those who do not reflect the truth or make manipulative posts on their social media accounts.

With the social media law comes a prison sentence of up to 3 years!

The Social Media Law was submitted to the parliament on May 26, 2022. However, it was decided to add the crime of publicly disseminating misleading information to the Turkish Penal Code No. 5237. In particular, broadcasting organizations and individuals who do not reflect the truth or directly make fake news will be sentenced to imprisonment from 1 to 3 years.

After the proposal, article 217/A was added to article 217 of the Turkish Penal Code. The following sub-headings were included in this regard:

A person who publicly disseminates false information regarding the internal and external security, public order and general health of the country, with the motive of creating anxiety, fear or panic among the public, in a way that is suitable for disturbing the public peace, is punished with imprisonment from one year to three years. If the crime is committed by hiding the real identity of the perpetrator or within the framework of the activities of an organization, these penalties will be increased by 50 percent.

Although the social media law seems to affect the organizations that make news on the internet, there are many journalists who share their news and broadcast on social media such as Facebook, Twitter and YouTube. Therefore, this decision will also include them.

Of course, this will not only include journalists. If any person shares false and misleading news or engages in manipulative actions on social media, they will be considered under the same law and face a prison sentence.

But let me point out that there are some reservations about this. Because, people think that more explanatory information should be shared about what and who will be involved in what is called fake news, to what extent, and by whom, according to what authority and criteria, and what to look for in case of criminal action, since there is no precedent.
