Social Media Law has been published in the Official Gazette!

The Anti-Disinformation Regulation, known as the Social Media Law, which was first presented to the Grand National Assembly of Turkey on May 26, 2022, was recently put to the parliamentary vote and passed. It entered into force today by being published in the Official Gazette.

With the “Law Amending the Press Law and Some Laws” published in the Official Gazette today, the regulation we know as the Social Media Law has officially entered into force. So what will change with this law?

The newly added 40-article law covers not only organizations engaged in internet journalism, but also all platforms that fall under the umbrella of Social Media, especially sites such as Facebook, Twitter and YouTube. Therefore, it includes people who share, that is, all citizens, regardless of whether they are journalists or not.

With the regulation published in the Official Gazette today, technological products can no longer be returned at the request of the consumer.

When we look at the 40 articles published in the Official Gazette, there are many details from the regulation on the press card of the journalists to the coverage of the websites and the imprisonment of up to 3 years for the sharing of misleading information.

Article 29, which caused protests in the parliament, is as follows:

“ARTICLE 29- The following article has been added to the Turkish Penal Code dated 26/9/2004 and numbered 5237, following article 217.

“Do not publicly disseminate misleading information.

ARTICLE 217/A- (1) A person who publicly disseminates false information regarding the internal and external security, public order and general health of the country in a way that is suitable for disturbing the public peace, just for the purpose of creating anxiety, fear or panic among the public, is liable for a period of one year to three years. punishable by imprisonment.

(2) If the perpetrator commits the crime by concealing his true identity or within the framework of the activities of an organization, the penalty imposed according to the first paragraph is increased by half.”
