As the Ministry of Commerce, with the amendment made in the Regulation on the Trade of Second-Hand Motor Vehicles, marketing of second-hand motor vehicles at a price higher than the current sales price recommended by the manufacturer or distributor, is prohibited until January 1, 2024.

Within the scope of the regulation that entered into force as of 15 July, all real and legal persons are warned by the “advertising platforms” during the posting phase; Despite this warning, the advertisements given in violation of the aforementioned prohibition and information regarding the advertisers are transmitted to our Ministry and are followed up.

It has been determined that the total number of individual and commercial advertisements, which were published on the advertisement platforms prior to the entry into force of the advertisement restriction regulation, which may constitute a violation of this regulation, was over 20 thousand. As a result of the warnings and notifications made to its members by the announcement platforms and the public information made by our Ministry, it was observed that this number decreased to the level of 7 thousand as of July 15, 2023, when the regulation came into effect. In the last examination, it was understood that the total number of advertisements that may constitute a violation of the aforementioned regulation fell below 5 thousand.

In this context, information regarding the aforementioned advertisements was obtained from the relevant advertisement platforms and the examination of these was started by our Ministry. As a result of the examination carried out by our Ministry, an administrative fine of up to 300,000 TL per advertisement is imposed on real and legal persons who place advertisements that are found to be in violation of the restriction. The notification process of these penalties to the addressees has started and continues.

In this context, utmost care and sensitivity is expected from all our citizens and businesses that place individual or commercial advertisements on advertisement platforms, in order to post vehicle advertisements in compliance with the advertisement restriction that entered into force on July 15, 2023.

In addition, as it is known, a maximum of three vehicles are allowed to be sold in one year in individual sales, and sales above this require a penal sanction as they are considered commercial activities. Persons who sell by proxy, including their first-degree relatives, have been examined by our Ministry, and necessary penal actions are being taken.
