Shortly after the court’s decision to extradite Do Kwon, the US Department of Justice (DOJ) appealed it. The DOJ cited several international agreements as a basis for its objections to Do Kwon’s extradition to South Korea. He also said that Montenegrin law does not allow this. Meanwhile, the United States is also demanding Do Kwon’s extradition. Both countries have filed accusations against Do Kwon regarding Terraform Labs. For this reason, Do Kwon’s extradition process between the USA and South Korea turned into a snake story. In a recent statement, DOJ outlined the following points:
The United States continues to request Kwon’s extradition in accordance with relevant international and bilateral agreements and Montenegrin law. The United States appreciates the cooperation of Montenegrin authorities in ensuring that all individuals are subject to the rule of law.
It is possible for South Korean and US officials to reach an agreement
Do Kwon’s extradition to South Korea is scheduled for March 24. However, the Supreme State Prosecutor’s Office says that procedural errors were made. Therefore, he claims, the case should be referred to the country’s Supreme Court. He accuses the Court of Appeals and the Supreme Court of mishandling Do Kwon’s case. Prosecutors also state that they “exceeded the authority of the Minister of Justice to order extradition, which is his exclusive right.”
By all indications, extradition to South Korea is not the final decision. Because it is possible for Montenegrin government officials to proceed in the direction they want: extradition to the USA. It is also worth noting that if he is extradited to South Korea, the United States may still request that he be tried first in New York.
