Legal opinion considers new property tax to be unconstitutional

Berlin Quite a few real estate owners have looked shocked at their new property tax assessment in the past few weeks. Some are threatened with a tax ten times higher than before if municipalities do not lower the tax rates. Now there is hope for these real estate owners: According to a legal opinion by the tax lawyer Gregor Kirchhof on behalf of the taxpayers’ association and the Haus & Grund owners’ association, the property tax is unconstitutional.

The report is now intended to serve as the basis for constitutional complaints by both associations. “It’s obvious that the new property tax doesn’t work that way,” says the President of the Taxpayers’ Association, Reiner Holznagel.

This means that an ever-increasing wave of lawsuits is rolling towards the tax authorities. Millions of taxpayers have already lodged appeals against their property tax assessments. Whether this makes sense, however, is debatable.
