EU makes greenwashing a million-dollar risk for companies

The EU draft stipulates that all environmental advertising claims must be certified in advance by an independent testing body.

Dusseldorf Many companies still advertise with labels such as “climate neutral” or “CO2 neutral” in order to distinguish themselves among increasingly environmentally conscious consumers. But that could take revenge. Because a new EU directive against greenwashing is likely to become an incalculable risk of millions for the economy.

“The dimensions of the effects are comparable to those of the diesel scandal,” warns Christoph J. Crützen, partner at the Mayer Brown law firm in Düsseldorf. “In the future, there could be a very high fine for every misleading advertising statement.”

The draft directive provides for fines of up to four percent of global annual sales. “The greatest danger for companies is that this EU directive will apply retrospectively in many areas,” explains Crützen. This means that you can be warned for making today’s statements if the directive has been transposed into national law in two years at the latest.
