Hard days are ahead for Apple and its smart watch, the Apple Watch. The International Trade Commission (ITC) has ruled that Apple is infringing on a healthcare company’s patents. US President Joe Biden did not appeal the decision. This, Apple Watch may be banned from importing into the US means.

Apple Watch could be banned in the US for patent infringement

The company named AliveCor first applied to the ITC in 2019, with an electrocardiogram (ECG) technology on Apple Watch without permission. After reviewing this application, the ITC decided to stop the import of the Apple Watch to the US.

In addition, Apple has suspended the stay order, appealing another decision of the U.S. Patent Trial and Appeals Board. However, the Biden administration did not veto ITC’s decision on the Apple Watch. This means there will be more pressure on Apple to resolve the patent infringement.

Import of Apple Watch into the US may be prohibited if the ban issued by the ITC is enforced. Given its popularity among users, Apple’s sales and profits could be significantly affected.

The dispute between Apple and AliveCor has been going on for several years. In 2019, AliveCor sued Apple, alleging that the Apple Watch Series 4 and later models used ECG technology without permission. Apple said AliveCor’s patents are invalid.

In response to the Biden Administration’s decision, AliveCor CEO Priya Abani issued a statement supporting President Biden as he endorsed the ITC’s decision and held Apple responsible for infringing on his patents.
