2nd Indictment for Thodex Founder: How Much Penalty Is Requested?

Anatolian Chief Public Prosecutor’s Office completed the second investigation file against 21 people, including Thodex founder Faruk Fatih Özer, on the grounds of fraud, with the complaints of 572 victims. In this indictment, the Prosecutor’s Office requested heavy penalties for 21 people, including Özer. According to the Financial Crimes Investigation Board (MASAK) report, the total loss of the victims is 94 million lira.

Meanwhile, Faruk Fatih Özer and 7 suspects were listed as organization managers in the indictment. In addition, the prosecutor included the claim in the indictment that 13 suspects were members of a fraud organization. It was requested that Thodex founder Faruk Fatih Özer be sentenced to a total of 11 thousand 462 years in prison for the crimes of “laundering assets resulting from crime”, “qualified fraud” and “establishing and managing an organization”. The prosecutor requested prison sentences of varying lengths of time for other suspects for similar crimes. The Prosecutor’s Office sent the indictment to the High Criminal Court. After this, the trial process will begin.

Cryptocurrency exchange and fraud story

Thodex suddenly went offline in April 2021. After this, Faruk Fatih Özer disappeared from sight. Before this incident, Thodex was one of the largest cryptocurrency exchanges in Turkey. More than 400,000 members were left in the dark, unable to access $2 billion in cryptocurrency deposits. Faruk Fatih Özer fled to Albania. However, Interpol issued a red notice about him. After this, the Albanian court arrested him in August 2022. Thus, the return process began.

In April last year, Albania extradited Özer to Turkey. Özer was detained for seven crimes, including establishing and managing an organization for the purpose of committing a crime, being a member of an organization, fraud by using information systems of banks or credit institutions as a tool, fraud of merchants or company managers and cooperative managers, and laundering of assets resulting from crime.

When the incident was revealed, Thodex founder Özer’s brother, sister and four other senior employees were imprisoned and at least 83 people were detained within the scope of the investigation. In the final trial, 21 defendants faced a prison sentence of up to 40 thousand 564 years. In September last year, the Anatolian 9th High Criminal Court announced its decision. Accordingly, it decided to acquit 16 of the 21 defendants. He ordered the release of four of the seven detained defendants due to lack of evidence. The court gave different degrees of prison sentences to the other defendants for various crimes.
