US Attorney Thinks ‘Big Judgment’ In Ripple Case Could Coming Soon

James K. Filan said on Twitter:

I have some thoughts on timing regarding the Hinman papers, summary resolutions, and pending sealing issues. Instead of writing a long article, I wrote them in the attached document.

In a document he added to the tweet, Filan drew attention to three major issues that stood out: summary judgment motions, expert objections (“Daubert motions”), and finally, sealing issues related to expert reports, Hinman documents, and other material relied on by the SEC and Ripple in their motions.

Filan believes the resolution of these issues can be intertwined and interdependent. That means, in his view, it will determine what District Judge Torres relies on in making his decision on the summary judgment, and possibly what the final decision might look like.

On this basis, Filan says he thinks that a separate decision on pending issues should not be expected.

He continues his earlier prediction that District Judge Torres will decide matters simultaneously and in “one large written decision.” He believes this will happen by March 31, 2023.

Ripple announced in October that it now has the much-requested documentation of former SEC official William Hinman, who declared ETH a non-security at a conference in 2018.
