Berlin The letter that gets insolvency administrator Jürgen Wallner into trouble consists of two pages and two powers of attorney. Wallner offered in September 2021 that investors in the insolvent eco-investment group UDI could sign one of the forms. “Depending on which lawyer you want to mandate”, the selected lawyer will represent you at the creditors’ meetings. Wallner had good news: “You will not incur any costs.”
It wasn’t long before other investor advocates were yelling “foul play.” They see themselves disadvantaged by the pre-selection of lawyers. Shortly before the meeting of creditors, the law firm Schirp & Partner from Berlin asked the district court in Leipzig to dismiss Wallner. The Dresdener is not independent, the reason given was that he had “destroyed the fundamental trust in proper action”. Nothing happened for a long time.
