Dusseldorf In autumn 2019, Eon and RWE sealed a deal worth billions. They exchanged a number of business areas and fundamentally repositioned themselves. Now they have to worry about this agreement again. On June 15, the Court of Justice of the European Union (CFI) in Luxembourg will examine in a hearing whether the approval of the transaction by the competition authorities of the EU Commission was legal. The Handelsblatt learned this from circles of those involved.

Eleven municipal utilities had filed two actions for annulment against the approval of the transaction in mid-2020 and early 2021. They accuse the two major corporations of restricting competition with their deal – and above all fear the negative consequences for consumers in view of the market power of the two heavyweights.

A first lawsuit is now being heard. The hearing is scheduled for three days. In addition, the number of judges was probably increased by two to five.
