Corona test

Anyone who falls ill with Corona while on vacation and is declared unfit for work by the doctor is credited with vacation days.

Dusseldorf Whether at a crowded airport or when partying without hygiene rules – many travelers are currently contracting Corona while on vacation. Even vaccinated people are currently not as well protected against infection with the highly contagious new omicron variant BA.5 as with previous variants.

This raises questions for the world of work. Do employees have to inform their boss about their illness while on vacation? Under what circumstances are vacation days re-credited? Tobias Brors, specialist lawyer for labor law from the nationwide law firm Pusch Wahlig Workplace Law, answers the most important questions for employees:

I fell ill with Corona while on vacation. Do I get my vacation days back?

Anyone who becomes ill on holiday is generally credited for all sick days. To do this, employees must submit a corresponding certificate to their employer; a positive corona test is not sufficient. Anyone who falls ill abroad must have their incapacity for work certified by a local doctor.
