Dispute between WestLB successors goes to the Federal Court of Justice

Cologne, Frankfurt The billion-euro dispute between WestLB’s successors, Portigon and Erste Bank (EAA), becomes a case for the Federal Court of Justice. According to information from the Handelsblatt, Portigon will not accept the recent defeat it suffered at the Higher Regional Court in Frankfurt and will file a non-admission appeal.

This puts the matter under legal scrutiny again. A Portigon spokesman declined to comment when asked. “It is not surprising that Portigon AG is taking this path,” said a spokeswoman for the EAA. In addition to the Linklaters law firm, the EAA hired BGH lawyer Thomas Winter for the dispute.

Portigon wants to take legal action to force the EAA to take on the tax authorities’ claims for reimbursement: the tax office is demanding around EUR 600 million in taxes and a further EUR 400 million in interest from Portigon AG. It is about contaminated sites from illegal cum-ex transactions of the former North Rhine-Westphalian state bank WestLB.
