Change in used car sales regulations!

The Covid-19 pandemic and the subsequent process undoubtedly affected the technology sector the most. Especially in Türkiye, the automotive sales process got out of control. But successive steps and high deterrent penalties aim to get things back on track. Finally, today, the decision to cancel the second-hand authorization certificates of those who do business against the citizen in the sale of new cars was published in the Official Gazette. Those who require high prices, compulsory accessories and exchange conditions will be deprived of their second-hand car sales authorization!

First of all, let’s examine the decision published in the Official Gazette today, and then what it means. The decision is as follows:

ARTICLE 1- The following paragraph has been added to the first paragraph of Article 9 of the Regulation on the Trade of Second-Hand Motor Vehicles published in the Official Gazette dated 13/2/2018 and numbered 30331, and the phrase “(ç)” in the third paragraph is replaced by “(ç) and (d) was changed to “Bindings”.

“d) The company, which is also engaged in the first registration motor land vehicle trade, refrains from selling while carrying out this activity, demands a price higher than the sales price of the vehicle recommended by the manufacturer or distributor, forces the consumer to buy accessories or barter, or sets the clearing price significantly below the market price. In case of activities that make it difficult to reach the first registered motor land vehicle, such as,

ARTICLE 2- This Regulation enters into force on the date of its publication.

ARTICLE 3- The provisions of this Regulation are executed by the Minister of Commerce.

Since the beginning of 2022, citizens have been constantly talking about irregularities in new and used car sales. These are mainly; It can be shown that the galleries sell at high prices by buying in bulk, the dealers turn the limited number of vehicles they have into an opportunity and make compulsory sales of accessories, and those who do not accept this, saying that they do not have a vehicle, are not sold.

The regulation of the ban on sales of commercially purchased automobile models, which came to the fore in the past days, was published in the Official Gazette today.

Of course, this situation was relatively prevented by the decision taken in August of last year. In this decision, it was said that the dealers who made a zero-bulk purchase could not sell the vehicle for at least 6 months and before the vehicle had traveled 6 thousand km. In other words, sales of new cars were banned. Of course, there were also those who bought the vehicles and deposited them for 6 months and sold them by taking the penalty to be paid (by adding the fine to the price of the vehicle and demanding it from the citizens).

However, with the decision taken today, no penal action will be applied if this situation is detected. Instead, second-hand car purchase and sale authorization certificates will be temporarily revoked. In other words, the turnkey price determined by the manufacturer of the car will be sold by the dealer over that amount. Those who add mandatory accessories or attempt to sell them at high prices through the gallery are temporarily expelled from the sector.
